Terms

[Draft for counsel] This text is a draft. It is not legal text until counsel has approved it. Effective date: [to come].

1. The service

Legatee connects you with a notary public appointed by the Chief Justice of Nigeria, for a notarial act performed by audio-visual means under the Notaries Public Act 2023, and keeps the record the Act requires.

2. Who may use it

Anyone with a phone number that can receive our sign-in codes, who passes the identity check and pays the fee. [to confirm: which countries] Notaries must be appointed by the Chief Justice of Nigeria, approved on Legatee, and registered with the Chief Registrar for electronic acts.

3. Your account

You sign in with your phone number and a one-time code. Keep your phone secure. Tell us if you believe someone else has used your account.

4. Fees, payment and refunds

Each document type has one fixed fee, shown before you start. You pay when you book. You may move or cancel a session up to two hours before it starts for a full refund. You are refunded in full if your notary declines. If your notary does not attend, or the session is interrupted, you may choose a free rebooking or a full refund. If you do not attend, you may rebook once within 14 days; after that the case closes without a refund.

5. Sessions and recording

Every session is recorded, and the recording is kept and filed as the Act requires. You must appear in person on camera, show your identity document when asked, and sign only for yourself.

6. Documents and the seal

You are responsible for the content of the documents you upload. Your notary may ask for changes, or decline the act with a reason. A sealed document carries the notary’s digital signature and may not be altered.

7. Verification

Anyone holding a sealed document may verify it at legateetrust.com/v. The verification page shows the document type, the notary, the date and the reference only, and, for a revoked act, when and why it was revoked.

8. Notaries

A notary on Legatee acts in their own capacity under the Act. [Counsel: to confirm] Legatee collects the fee and pays the notary their share after the act is sealed.

9. What you must not do

Use a false identity, upload content you have no right to, interfere with the service, or attempt to probe the verification page.

10. Our responsibility

[Counsel: limitation of liability]

11. Ending

You may ask, in the app, for your account to be deleted. What the law requires is kept, and the app tells you what and why. [Counsel and founder: when an account may be suspended]

12. Law and disputes

[Counsel: governing law and venue]

13. Changes

We will post changes to these terms here, with the date they take effect.
